General Terms, Conditions, & Disclosures
Not Included in Rates:
Unless otherwise noted in the individual description sheet provided for each property, rates do not include 13.416%, General Excise Tax (4.166%) and Transient Accommodation Tax (9.25%).
Restrictions on Occupancy & Property Use:
Properties are rented for the occupancy and use of the number of persons as specified on the Rental Agreement. Extra occupants can result in extra charges or in rental termination. Parties, weddings, receptions, or other such activities which involve more than 2 non-occupant guests are not permitted without written owner approval.
ResorticHawaii.com, Inc. will issue a Rental Agreement for each booking that indicates the name and address of the property rented and the calendar dates reserved, what is included in the rate quoted, any charges additional to the rental rate and any terms or disclosures specific to that rental. The Rental Agreement supersedes all prior communications, whether written or oral; stated or implied, and it must be executed by the person(s) assuming financial and legal responsibility for the booking and for all other occupants and invited guests who will be using the rented property.
Deposits & Payments:
A reservation deposit, equal to 30% of the total rental rate and a signed Rental Agreement must be received within 7 days of placing a reservation or the booking may be canceled without further notice. All rental charges, taxes, security/damage deposit and any additional charges on the Rental Agreement must be fully pre-paid 60 days prior to arrival date. Reservations made within 60 days of arrival will require full payment. Reservations made within 30 days of arrival will require full payment by cashier's check or wire transfer. Failure to remit deposits and payments by the due dates shown on the Rental Agreement will make the reservation subject to cancellation and will result in forfeiture of deposits or funds previously paid. Credit cards (AMEX, Discover, MasterCard, VISA) are accepted for deposits and payments.
All of our properties come with $1500 of Accidental Damage Insurance Coverage for $39. If you opt out of this coverage, you will be required to provide a $1,000 security deposit in the form of a personal check. The deposit will be refunded to you 14 days after check out. Guests are responsible for any costs that exceed the damage.
Cancellation & Refund Policies:
At many rental properties deposits and payments are non-refundable; at others, they are non-refundable unless written cancellation is received 61 - 91 days prior to the scheduled arrival date shown on the Rental Agreement. Cancellations received after the specified number of days prior to arrival will forfeit any deposits and funds previously paid. Pro-rata refunds (less a cancellation fee of 20% of the total rental) will be given by many properties if the canceled dates can be re-rented at an equivalent rate and length of stay. Trip cancellation insurance is strongly recommended. In the event a property should be sold or become unfit for habitation, and no equivalent substitute property is available, a full refund will be given for any unused rental time. ResorticaHawaii.com, Inc.’s Rental Agreement will contain complete details about payment and cancellation policies pertaining to a specific property rented and to a specific individual booking.
Liability Limits and Waivers:
ResorticaHawaii.com, Inc. acts only as an agent for the various owners, managers, properties and service providers and does not own or manage any property nor does it have direct supervision of, or control over, property owners, local managers, and/or service vendors and accepts liability only as prevailing Hawaii law may deem consistent with its role as an agent and as specified in and limited by the terms of the Rental Agreement. Renter assumes responsibility for, and holds ResorticaHawaii.com, Inc. harmless from claims for loss or damage resulting from, or in consequence of, any and all "renter-accepted risk factors" disclosed herein and/or in the Rental Agreement. Information regarding activities, tours, or any other such service is provided in good faith, and does not endorse any such vender. We accept no liability for any damages, injuries or dissatisfaction with any such vender or service provider.

In order for us to provide accurate responses and appropriate recommendations when you initiate an inquiry to obtain further information or to ascertain availabilities for specific properties or services, whether by phone or via our website request form, in the processing of your requests we may obtain the following information:
1.) Your name
2.) The name of accompanying family members and/or companions;
3.) Your residential and/or business address;
4.) Your residential and/or business telephone and fax numbers;
5.) Your personal and/or business email addresses; and,
6.) Your travel and accommodations preferences
In the course of confirming reservations and arranging payment we may also obtain one or more of the following items of personal or financial data:
1) Your bank account and/or credit card numbers
2) Your billing address for said credit card
How We May Use Information Obtained from You
We may provide information collected from you to individual owners, brokers or property management companies for the purposes of securing approval for a rental or in the course of payment of a rental for a specific property or to vendors who may be engaged to provide ancillary services in connection with a rental.
Unless you request otherwise, we may also provide non-financial information such as your name, address, phone/fax and email contact address to our subsidiary and affiliate companies for the purpose of sending future offers and updates on products and services. You have the right to opt-out of having your information shared with affiliated or with non-affiliated companies by emailing your request to info@ResorticaHawaii.com . If you exercise to opt-out, your request will be implemented as soon as is reasonably practical. Your opt-out, however, will not apply to affiliated companies and vendors to whom your information has already been supplied in connection with reservations and services requests.
Security of the Information You Provide
ResorticaHawaii.com, Inc. maintains a proprietary database of information obtained from information requests and/or reservation requests.
We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you.
